THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.21921 of 2010 ORDER:
This Writ Petition is filed seeking the following relief/s: - ".....to issue a Writ more particularly one in the nature of writ of Mandamus declaring the action of the 1st respondent in issuing proceedings No.B/687/2010, dated 23.08.2010 is illegal, arbitrary and unjust and consequently set aside the same by directing the respondents to include the petitioner's members in the voters list and pass such further other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case"
(Reproduced Verbatim) The learned counsel for the writ petitioner, while drawing the attention of this Court to the proceedings dated 17.10.2011 bearing No.B/687/2010 of the Returning Officer/Verification Officer and the Deputy Commissioner of Labour, Nalgonda had submitted that after the interim order granted by this Court was vacated, the results of the elections were declared and that therefore, the cause in the writ petition does not survive for adjudication and hence, the writ petition may be disposed of giving liberty to the writ petitioner to seek appropriate remedy before an appropriate forum, which the law permits.
The learned counsel for the respondents 2 and 4 are present. Recording the aforesaid submission of the learned counsel for the writ petitioner, the Writ Petition is disposed of as no cause survives for adjudication, however, giving liberty to the writ petitioner to approach an appropriate forum and seek appropriate remedy, which the law permits, if it so desires. No costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
