THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos. 16182, 16186 and 16188 of 2011 COMMON ORDER:
The petitioners in these three cases are aggrieved by the maintenance of history sheets against them by the Allagadda Police Station, Kurnool District.
The Sub Divisional Police Officer, Allagadda Sub Division, Kurnool District, furnished written instructions dated 8.06.2015 to the office of the learned Government Pleader for Home in these three writ petitions stating that rowdy sheets had been opened against the petitioners in these cases in the year 1996 owing to their involvement in criminal cases. The details furnished of the said criminal cases demonstrate that they either ended in acquittal, binding over for good behaviour or were closed for lack of evidence. In one case, viz., S.C.No.161 of 2000 on the file of IV Additional District Judge, Kurnool, the petitioners in these three cases were the accused and were convicted and sentenced to life imprisonment. However, they were thereafter released by the State on remission of their sentences.
The Sub Divisional Police Officer further stated that it would be open to the petitioners to submit representations to the competent authority to close the history/rowdy sheets opened against them and that such requests would be considered in accordance with law.
sheets maintained against the petitioners on the file of Allagadda Police Station.
The writ petitions are therefore disposed of permitting the petitioners to approach the competent authority by way of suitable representations seeking closure of the history/rowdy sheets opened against them. In the event such representations are made, the competent authority shall consider the same and take appropriate action thereon in accordance with law.
Pending Miscellaneous Petitions in all these cases shall stand closed. No order as to costs.
