Order:

This Writ Petition is filed for the following substantive relief:

"to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of Respondent Nos.2 to 4 in withholding an

amount of Rs.51,51,516/- in package No.22 of HNSS Phase II in Chittoor District, towards the maintenance charges @ 2% from the total value of work done, as arbitrary, illegal, against the terms of contract and agreement No.

SEH1/EPC/2006-07, dated 30-11-2006, and consequently, direct respondent Nos. 2 to 4 to release the withholding amount of Rs.

51,51,516/- to the petitioner henceforth."

In the counter-affidavit, filed by respondent No.3, it is inter alia stated that in pursuance of the interim direction granted by this Court on 11-052012, the respondents have released the sum of Rs.51,51,516/- under L.S.XII & Part Bill, dated 18-052012, to the petitioner. Mr.Bethi Venkateswarlu, learned Counsel for the petitioner, submitted that in the light of the fact that the interim order has worked itself out, no further adjudication of the Writ Petition is necessary. In view of the above submissions of the learned Counsel for both the parties, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.No.17284 of 2012, filed by the petitioner for interim relief, is disposed of.
