THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40527 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent No.1 in interfering with the civil disputes and trying to dispossess the petitioner from his land admeasuring Ac.6.09 cents in Survey No.189 situated at Chinnayagudem Village, Devarapalli Mandal, West Godavari District as illegal and arbitrary and consequently, direct respondent No.1 not to interfere with the said land of the petitioner.

Case of the petitioner is that he is in possession and enjoyment of the aforementioned land having patta and relevant documents; that some of the villagers, taking advantage of his old age, sent complaints to respondent Nos.2 and 3 that the land in question belongs to the Government for which respondent No.3 forwarded the said fake complaints to respondent No.1, but respondent No.1, instead of requesting respondent No.2 to conduct an enquiry as per the revenue records, is frequently calling him to the police station and harassing him in the name of enquiry; that respondent No.1 should not interfere with the civil disputes; that he also sent a representation on 14.11.2016 to respondent No.2 requesting him to initiate action against the persons who made the false complaints; that respondent No.1 is not making any efforts to contact respondent No.2 to verify the right, title and interest of the petitioner over the said land.

Heard and perused the material available on record.

Considering all the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of with the following direction:

The petitioner is directed to give a representation to the Superintendent of Police, West Godavari District informing the high handed action of respondent No.1 herein and on such representation, the Superintendent of Police, West Godavari District shall dispose of the same in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
