THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34222 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent and its officials in causing harassment to the petitioner by way of making illegal house search, asking him to come to the police station without any reason and threatening to file false cases against him as illegal, arbitrary and against the principles of natural justice and consequently to direct the third respondent not to proceed against the petitioner without following due process of law.

Heard and perused the material.

Learned counsel for the petitioner submits that since a case is registered against the sister of the petitioner herein, he is called to the police station very frequently and is asked to sit in the police station whole day and thereby harassing the petitioner, and as such, he prays this Court to direct the third respondent and its officials not to indulge in any such activity without following due process of law. Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the affairs of the petitioner and that the third respondent is not taking any coercive steps against the petitioner herein and if any case is registered, the third respondent will proceed in accordance with law. Considering the rival submissions made by both the counsel, the third respondent is directed not to harass the petitioner by way of calling him to the police station, and to proceed in accordance with law if there is any crime registered against the petitioner.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 17.10.2016 pln
