HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.29787, 29794, 29796 and 29797 of 2016 COMMON ORDER:

These writ petitions are filed challenging the notice dated 05.11.2015 issued by the 3rd respondent vide proceedings No.B/2638/2015.

Learned counsel for the petitioners submits that the lis in these writ petitions is covered by the Judgment rendered by this Court in Dasari Narayana Rao and another v. Deputy Collector and Mandal Revenue Officer, Serilingampalli, R.R.District reported in [2010 (6) ALD 536], as the impugned notice is not issued in prescribed format and does not give the details of assignments and file number and also very vague. He also submits that no notice is issued to the petitioners.

Heard learned Assistant Government Pleader for Revenue.

In the counter it is stated that notices affixed on the gate of the compound wall of property which goes to show that petitioners are not served with the notices. A reading of the impugned notice also goes to show that no details of assignment are given as held by this Court in the aforesaid Judgment. In view of above facts and circumstances and in view of the law lad down by this Court in the aforesaid

Judgment in Dasari Narayana Rao and another v. Deputy Collector and Mandal Revenue Officer, Serilingampalli, R.R.District, the impugned notice is set aside and it is open for the respondents to issue fresh notices to the petitioners giving particulars is required by law, as laid down by this Court in the aforesaid Judgment.

Accordingly, all the writ petitions are allowed to the extent indicated. No order as to cots.

Consequently, miscellaneous petitions, if any, pending in the Writ Petitions shall stand closed.
