HON'BLE SRI JUSTICE P NAVEEN RAO CRIMINAL PETITION NO. 21 OF 2015 ORDER:
This criminal petition is filed under Section 438 of Cr.P.C by petitioner /accused in FIR No.335 OF 2014 of Marredpalli police station, Hyderabad for the offences punishable under Sections 31(1) (iii) and under Section 3 (1) (X) of SC, ST (Prevention of Atrocities) Act and Sections 420, 506 and 379 of Indian Penal Code.
2. Heard the learned counsel for petitioners and learned Additional Public Prosecutor for respondent -State and perused the material placed on record.
3. The allegation against the petitioner/accused is that on 21.10.2014 at about 1245 hrs the accused along with two others abused the defacto complainant in filthy language touching the caste.
4. Learned counsel for petitioner submitted that petitioner is falsely implicated into the crime and the allegations alleged against him in the complaint do not constitute any offence and in abuse of process of law.
5. Having regard to the above, the Criminal Petition is disposed of by giving liberty to petitioner/accused to surrender before the learned Special Judge concerned and to move regular bail application after notice to the Public Prosecutor and in such an event the learned Special Judge concerned is required to consider on its own merits the application to grant bail preferably on the same day, if not atleast on next day and subject to such conditions as may be necessary. __________________ P NAVEEN RAO, J
