THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed to declare the action of the respondents in not appointing the petitioners in the place of their respective deceased fathers, as fair price shop dealers, as illegal and arbitrary. At the hearing, the learned Assistant Government Pleader for Civil Supplies (TS) submitted that when the writ petition was filed, the policy of appointment on compassionate grounds was not in existence and that under G.O. Ms. No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dt.28.2.2014, the said policy has been introduced.

In the light of the above submissions, the petitioners are permitted to make a representation to respondent No.3 within one month from today. On such representation being received, respondent No.3 shall consider the petitioners' claims strictly in terms of G.O. Ms. No.4, dt.28.2.2014, and communicate the decision to the petitioners within one month thereafter.

Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.10174 and 10175 of 2012 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 23-6-2015 bnr
