HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1235 OF 2009 ORDER:

This writ petition is filed challenging the proceedings vide RC.No.C.2/5769/2007, dated 19.01.2009, issued for grant of lease hold rights for one year.

This Court while admitting the writ petition on 28.01.2009, granted interim order on 28.01.2009 in WP.MP.No.1555 of 2009 stating that the auction as contemplated vide impugned notification dated 19.01.2009 may go on in respect of all the items, including item No.5; and however, the auction against Item No.5 shall not be finalized until further orders and that the petitioner shall be allowed to do business on the same terms and conditions as was being done earlier.

Learned Government Pleader for Endowments states that since the notification issued only for a period of one year, by afflux of time, the cause in the writ petition does not survive for adjudication.

Recording the above submission, the writ petition is dismissed as infructuous. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
