THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.11947 of 2011 ORDER:
The action of respondents 3 to 5 in not making deletions or additions in the electoral roll of the subject Gram Panchayats is questioned in this writ petition as being arbitrary and illegal. In the counter-affidavit, filed on behalf of respondents 1, 3 and 4, it is stated that as per the directions of the Chief Election Officer, Hyderabad dated 25.03.2011, and the District Collector, Kurnool, teams were formed to conduct house to house enquiry under the supervision of Tahsildars; the house to house enquiry was completed; thereafter, changes were carried out in the voters list of the Assembly Constituency and communicated to the Panchayat authorities to carry out the changes in the Gram Panchayat voters list; and, on completion of the house to house enquiry, a detailed report was submitted to the District Collector, Kurnool after carrying out changes in the voters list of the subject Gram Panchayats which fall within the limits of Banaganapalli Assembly Constituency.
As a house to house survey was conducted, albeit after the writ petition was filed, and consequent thereto the voters list was revised, it is evident that the cause in the writ petition does not survive necessitating any further adjudication by this Court. The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
