THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.18626 of 2018 ORDER:

Heard the learned counsel for petitioner and the learned Assistant Government Pleader for Civil Supplies appearing for respondents.

Petitioner has filed this Writ Petition challenging the action of 2nd respondent in taking steps to sell the entire seized stock of 530 bags of rice equivalent to 258.90 quintals worth of Rs.6,47,500/- in a public auction through interim disposal without giving any show cause notice to the petitioner and without permitting petitioner to submit any explanation.

Admittedly the said rice has been seized by the respondents under a panchanama conducted on 19-05-2018 in exercise of power conferred under Section 6-A of the Essential Commodities Act, 1955.

After hearing the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies, the respondents are directed to complete the proceedings under Section 6-A of the said Act within six weeks from the date of receipt of a copy of this order and till disposal of the same, the above mentioned stocks seized from the petitioner's premises shall not be sold. 5.

Accordingly, the Writ Petition is disposed of. No costs.
