HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18570 OF 2002 ORDER:

This writ petition is filed seeking to declare the proceedings dated 12.2.2002, issued by the respondents in not regularizing the services of the petitioner with effect from 10.9.1988, as illegal and arbitrary.

It has been contended by the learned counsel for the petitioner that the petitioner was initially appointed as Driver on 31.3.1988, and his services were disengaged on 12.4.1989 as the petitioner was indulged in an accident. Thereafter, the petitioner has filed I.D.No.153 of 1989 and the Labour Court vide award dated 10.8.1990, reinstated the petitioner into service and once again the petitioner was appointed as casual driver on 1.8.1993. The grievance of the petitioner is that similarly situated persons were regularized from the date of their initial appointments, but when it comes to the petitioner, he was regularized with effect from 25.11.1993.

Having regard to the above, the writ petition is disposed of directing the respondents to examine the case of the petitioner and pass appropriate orders and if the petitioner is found to be eligible, his case shall be considered for regularization from the date of his initial appointment. No order as to costs.
