HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24072 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking writ of Mandamus declaring the action of respondent Nos.2 and 3 in cancelling the allotment of vacant land bearing plot No.153 C, admeasuring 9138 square yards at Industrial Park, Tada Village and Mandal, Nellore District, made in favour of the petitioner, vide letter, dated 07.06.2016, without considering the representations, dated 10.11.2014, 15.11.2014, 28.01.2015, 25.02.2016, 04.05.2015, 08.06.2015, 19.09.2015 and 13.06.2016 submitted by the petitioner, for extension of time for completion of project, as being arbitrary and illegal.

2. Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos.2 and 3.

3. At the time of argument, the only relief sought for by the petitioner is to direct respondent Nos.2 and 3 to dispose of the representation, dated 13.06.2016, submitted by the petitioner. Learned Standing Counsel for respondent Nos.2 and 3 also consented for the same.

4. In view of the submissions made by learned counsel for both parties, this Court is not inclined to go into the merits of the case.

5. Having regard to the facts and circumstances of the case, respondent Nos.2 and 3 are hereby directed to consider the representation, dated 13.06.2016, submitted by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________
