THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7718 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/accused No. 3 seeking bail in the event of his arrest in connection with Crime No.177 of 2022 dated 11.11.2022 on the file of Thurkapally, Rachakonda Commissionerate, Yadadri Bhuvanagiri District, registered for the offence punishable under Section 286 of the Indian Penal Code (for short "IPC") and Sections 3 and 5 of Explosives Substance Act. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent - State and perused the record.

The case of the police is that they have seized machinery along with gelatin sticks and connecting wires meant for blasting, on 11.11.2022. The accused A1 and A2 were arrested on the ground of possessing explosive substances without a valid license. The said F.I.R was registered on 12.11.2022 and they were remanded to
judicial custody. The name of this petitioner was revealed by the accused No.1 during the course of his confession that he was a developer of this site where in the alleged blasting had to be carried out. The petitioner who is the developer of land can be granted relief of bail when there was no specific allegations against this petitioner except the confession of accused No.1. In the said circumstances this Court deems it appropriate to order as follows:-
1) The petitioner/accused No.3 is directed to surrender before the Thurkapally Police Station, Yadadri Bhuvanagiri District on 31.08.2023. Upon such surrender, the said Station House Officer shall release the petitioner/accused No.3 on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/accused No.3 shall appear before the concerned police every Monday and Wednesday for a period of eight
weeks at 10.00 a.m. or till filing of charge sheet whichever is earlier and thereafter, as and when required for the purpose of investigation.
3) The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 4.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
