HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43565 of 2016 ORDER:

This writ petition is filed seeking to declare the registering of FIR no.562 of 2016, as illegal and arbitrary and to set aside the same.

Heard and perused the material available on record. The case of the petitioners is that the 3rd respondent lodged the present complaint against the petitioners alleging that on 21.11.2016 at about 10.30 hours, one Kama Deva Raju and others trespassed into their building and break opened the shutter keys, damaged the property and threatened the 4th respondent and his son with dire consequences and assaulted them and also threatened to foist false cases under SCs & STs (POA) Act, 1989 and one K. Deva Raja and the 1st petitioner, who is an Advocate, demanded Rs.50,00,000/- to vacate the premises and they forcibly removed the Madhu's banners and put their caste banners and flag. The main grievance of the petitioners is that the allegations levelled against them are false and that the petitioners are apprehending arrest by the 2nd respondent.

Learned counsel for the petitioners submitted that the petitioners are ready to co-operate with the investigation. Considering the grievance of the petitioners and submissions of the learned counsel for the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.562 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute a personal bond for a sum of

Rs.10,000/- (Rupees ten thousand only) each with one surety each to the satisfaction of the 2nd respondent as surety for their future appearance for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
