ORDER: (per the Hon' ble Sri Justice C.V. Nagarjuna Reddy) This Writ Petition is filed for issue of Habeas Corpus, directing respondents 3 and 4 to produce Shankarlal S/o Mulla ram, husband of the petitioner, (for short, 'the detenu') before this Court and record his statement for appropriate action in the light of the various judgments of the Supreme Court and initiate appropriate criminal and civil proceedings against the erring police officials.
As it was alleged that the alleged detenu was taken into illegal custody on 02.05.2018 and that the police have come out with a false version that he was arrested on 15.06.2018, we have directed respondent No.4 to produce the alleged detenu before the Court. The alleged detenu is, accordingly, produced before the Court today. On our questioning the alleged detenu, he has denied that he was taken into custody on 02.05.2018. He, however, added that as he was suspected to have misappropriated the Gold belonging to his employer, he was called to police station three or four times before he was arrested on 15.06.2018. In the light of this version given out by the alleged detenu, and the fact that he was produced before the Judicial Magistrate following his arrest on 15.06.2018 and he is presently in judicial custody, the cause in the Writ Petition does not survive for adjudication.
