HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10737 of 2015 ORDER:

This petition is filed by the petitioner - Accused No.1 under Section 438 of the Criminal Procedure Code seeking to grant anticipatory bail to him in Crime No.124 of 2015 on the file of Inaguduru Police Station, Krishna District, registered for the offence punishable under Sections 420 r/w 34 IPC and 7 of the Essential Commodities Act.

Heard and perused the material available on record. It is alleged that even though the petitioner is the authorized dealer of the fair price shop, which was inspected by the officials, and incharge of two other shops, he is not maintaining the Fair Price shops and one Kandula Bapuji-A2, who is looking after the said fair price shops, committed irregularities by inserting his Aadhar number in place of multiple cards to draw the commodities for diversion into black market.

Considering the facts and circumstances of the case and the nature of the allegations, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
