THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7829 & 7752 OF 2023 COMMON ORDER:

Crl.P.No.7829 of 2023 is filed by A-2 seeking regular bail. A-2 was arrested on 04.08.2023. Crl.P.No.7752 of is filed by A-3 seeking anticipatory bail.

Since the cause in both the criminal petitions is one and the same, both are heard together and disposed off by this common order.

The de-facto complainant namely, Mohammed Nawaz filed a complaint on 20.07.2023 stating that while he was in Jagitial Tata Show Room where he was working a salesman, the petitioner herein/A-3 and two others on 19.07.2023 went to the show room stating that they intend to buy a vehicle. The de-facto complainant went in the car along with four others. He was beaten by these petitioners and two others with iron rods from 3:00 p.m. to 10:00 p.m. and also threatened with a knife. He was further asked to sign on a blank
bond paper. However, he was let off and immediately, he filed a complaint on the very next day.

Learned counsel for the petitioners would submit that the de-facto complainant was harassing the wife of A-2. Both, the de-facto complainant and wife of A-2 were acquainted prior to his marriage. For the said reason, a criminal complaint was filed against these petitioners and others which was registered as Crime No.234 of 2023 on the file of Karimnagar Rural Police Station for the offences under Sections 448, 354-D and 323 r/w. 34 of IPC against the de-facto complainant herein and four others.

Learned Additional Public Prosecutor instructions would submit that the de-facto complainant has received simple injuries and was treated as Out Patient.

As seen from the record, differences arose for the reason de-facto complainant allegedly contacting the wife of A-2.

In the said circumstances, this Court deems it appropriate to grant the relief of regular bail to A-2 subject to following conditions:
i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of I Additional Judicial Magistrate of First Class, Jagityal. ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer every Monday at 10:00 a.m. for a period of eight weeks or until the charge sheet is filed, whichever is earlier.
iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

And Anticipatory bail to A-3, subject to the following conditions:-
1) The petitioner/Accused No.3 is directed to surrender before the Station House Officer, Jagtial Town Police Station, Jagtial 28.08.2023. Upon such surrender, the said Station House Officer shall release the
petitioner/Accused No.3 bail, his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.3 shall appear before the concerned Police everyday at 10:00 a.m. till 04.09.2023 and thereafter, as and when required for the purpose of investigation.
3) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 9.
Accordingly, these Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
