HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.1189 of 2017

ORDER

Challenging registration of Cr.No.204 of 2016 by the 2nd respondent, the present writ petition is filed. While issuing notice before admission on 06.01.2017, this Court directed the respondent-police to proceed with the investigation, without arresting the petitioners. A reading of the complaint discloses a prima facie case against the petitioners.

In the circumstances, this Court is not inclined to interfere with registration of crime or investigation into the same. However, it is made clear that the police shall follow due process of law while investigating the crime, including compliance of provisions under Section 41-A of Criminal Procedure Code. Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
