HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.No.4625 of 2013 ORDER :

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners(A.1 and A.2 in Cr.No.468 of 2012) to quash the proceedings in Cr.No.468 of 2012 on the file of the Station House Officer, Uppal Police Station, registered for the offences u/secs. 403,406,408 and 420 of IPC outcome of a private complaint filed by the 2nd respondent-complainant before the learned III Additional Metropolitan Magistrate, L.B.Nagar who referred the same to the above police for investigation, and the same is pending investigation.

2. In the quash petition, it was already admitted on 08.05.2013 and initially there is stay as prayed for including of investigation and arrest, for 8 weeks in Crl.P.M.P.No.4245 of 2013 and subsequently as on date there is no stay extension and the stay vacate petitions filed also therefrom became infructuous.

3. Heard the learned counsel for the quash petitioners and also the 1st respondentstate represented by the learned Public Prosecutor and the learned counsel for the 2nd respondent-defacto complainant and perused the material on record.

4. A perusal of the material on record no way requires interference at this stage for this Court but for investigation shall go on by not to arrest the petitioners/A.1 and A.2 pending investigation and to file final report.

5. Accordingly and in the result, the Criminal petition is disposed of by directing the police to proceed with the investigation in the above crime (Cr.No.468 of 2012) but not to arrest the petitioners pending investigation, however, to complete investigation soon and file final report. Miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
