THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT SECOND APPEAL No.807 OF 2016 ORDER:
Vide order dated 20.03.2017, this Court recorded that on six consecutive occasions, the appellant made requests and got adjournments. The aforesaid observation was made on the request made by the learned counsel for the appellant, who sought adjournment to assist the Court on the next date of hearing.
2. It is pertinent to mention here that vide the aforesaid order dated 20.03.2017, this Court made it clear that no adjournment shall be granted on the next date of hearing. Further directed to delete the matter from the caption 'for dismissal' and list after two weeks.
3. On the said date also i.e., on 04.04.2017 the learned counsel for the appellant sought adjournment and accordingly the appeal was directed to be listed after two weeks.
4. Today, when the matter is taken up, appeared none on behalf of the appellant. It seems that the appellant is no more interested in prosecuting the case.
5. Accordingly, this Second Appeal is dismissed in default and for non-prosecution as well. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
