"This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.1, for grant of anticipatory bail in the event of his arrest in Crime No.206 of 2017 on the file of the Mills Colony Police Station, Warangal City, registered for the offences punishable under Sections 290, 323, 307 read with Section 34 of I.P.C.
Heard the learned counsel for the petitioner/accused No.1, learned Additional Public Prosecutor representing the respondent-State and perused the record. In the course of submissions made by the learned counsel for both the sides, it is brought to the notice of this Court that the other accused in this case were already granted regular bail. The petitioner/accused No.1 is a B.Tech. second year student. As per the Photostat copy of the Wound Certificate of the victim, the victim suffered two simple injuries, one on the skull and one on the left upper arm. The allegation is that the victim was thrown on the ground. The offence is alleged to have taken place
on 18.06.2017 and the report in this case was lodged on 22.06.2017. Having regard to the nature of allegations, this Court is inclined to grant bail to the petitioner/accused No.1 under Section 438 of Cr.P.C.
Accordingly, the petitioner/accused No.1 is directed to surrender before the Station House Officer, Mills Colony Police Station, Warangal City, within a period of 15 days from the date of this order. On such surrender, the Station House Officer, Mills Colony Police Station, Warangal City, shall release the petitioner/accused No.1 on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum each to his satisfaction. After being released on bail, the petitioner/accused No.1 shall report before the Station House Officer, Mills Colony Police Station, Warangal City, on every Sunday between 09:00 AM and 10:00 AM, till filing of the charge-sheet. The petitioner/accused No.1 shall also abide by the conditions stipulated in Section 438 (2) of the Code of Criminal Procedure, 1973, and shall cooperate with the investigation officer in the investigation of the case.
The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed."
