THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20868 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the second respondent in calling the petitioner to Police station regularly and interfering with the personal life and liberty of the petitioner, at the instance of R-3 to R-6, as illegal and arbitrary. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to unofficial respondents.

Learned counsel for the petitioner mainly submits that without any FIR being registered/pending against the petitioner, the second respondent is calling the petitioner to Police Station and thereby interfering with the personal life and liberty of the petitioner and also threatening the petitioner to settle the civil disputes pending with unofficial respondents. Learned Assistant Government Pleader denies the allegations made in the affidavit filed in support of the Writ Petition and submits that the allegation of petitioner that the second respondent is calling him to Police Station is incorrect. She further submits that if any action is sought to be taken by the second respondent against the petitioner, the same would be in accordance with the procedure established under law.

Having regard to the above, the Writ Petition is disposed of directing the second respondent not to interfere with the personal life and liberty of the petitioner without following due process of law. If the Police intend to take any action against the petitioner, the same shall be in accordance with the procedure established under law.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
