THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7815 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos. 1 & 3 in Crime.No.266 of 2023 on the file of Chaderghat Police Station, Hyderabad, registered for the offences under Section 307 r/w. 34 of IPC and 25 (1-B) of the Arms Act.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The complaint filed by the de-facto complainant on 20.07.2023 stating that he has a shop named RAP House near Saifa Masjid, Azampura, Chaderghat. A-1 was working in the said shop for the past two years. Since A-1 was not doing work properly, the de-facto complainant scolded him. On that, he went to the house and came along with relatives. There was a heated

argument and A-2 stabbed the victim/de-facto complainant, when A-1, A-3, A-4 and A-5 caught hold of the de-facto complainant.

Learned Additional Public Prosecutor on instructions would submit that the victim was treated and discharged from the hospital. There are no other criminal cases against these petitioners.

Keeping in view that there are no other cases against these petitioners, this Court deems it appropriate to grant the relief of regular bail to these petitioners, subject to following conditions:

i) The petitioners/Accused Nos.1 & 3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to the satisfaction of VIII Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioners/Accused Nos.1 & 3 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of one month and thereafter, as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 & 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
