THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.9383 of 2010 ORDER:

The relief sought for in this writ petition is to declare the action of the 2nd respondent-institution in not allowing the petitioner to attend classes of II semester of II year B.E Course as illegal, arbitrary and unconstitutional.

On the ground of shortage of attendance in the I semester of II year B.E course, the petitioner was detained and was not permitted to appear in the examination. Aggrieved thereby, he filed W.P.No.23948 of 2009 questioning his detention. By way of an interim order, the petitioner was permitted to write the examinations of I semester of II year B.E Course. On the ground that he was not permitted to attend classes for the II semester of II year B.E Course, the petitioner has filed the present writ petition.

W.P.No.23948 of 2009 filed by the petitioner was dismissed by this Court, by its order dated 07.07.2010, holding that since the petitioner did not even secure the minimum required 65% of attendance for condonation of shortage of attendance, there was no illegality in the action of the respondents in not permitting the petitioner to appear in the examination for the I semester of II year B.E Course. Consequently, the relief sought for in this writ petition, which is to permit the petitioner to attend classes in the II semester of II year B.E Course, cannot be granted.

The Writ Petition fails and is, accordingly, dismissed.

Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
