HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16402 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the orders dated 14.08.2002 issued by the 1st respondent promoting the respondents 2 to 6 to the posts of Divisional Managers, as illegal and arbitrary. A consequential direction is also sought to the 1st respondent to promote the petitioner to the post of Divisional Manager from the date on which his juniors so promoted with all consequential benefits.

When the matter is taken up for hearing, it is noticed that the petitioner has retired from service.

This Court, having considered the case of the petitioner, is of the considered view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents seeking to promote him on par with his juniors.

Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents seeking to promote him on par with his juniors notionally, within one week from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon in four weeks thereafter in accordance with the rules.
