HON'BLE SRI JUSTICE T. SUNIL CHOWDARY MACMA No. 660 of 2009 Order:

This appeal is filed by the claimants against the judgment and award dated 28.11.2008 passed in MVOP No.14 of 2007 by the Motor Accidents Claims Tribunal-cum-Principal District Judge, Kadapa, seeking enhancement of compensation.

2. When the matter is taken up for hearing, learned counsel for the appellants sought permission of this Court to withdraw the appeal with liberty to avail the remedies available to the appellants under law including the filing of petition under Workmen Compensation Act.

3. In the circumstances, permission is accorded and, accordingly, the MACMA is dismissed as withdrawn granting liberty to the appellants herein to avail the remedies available to them under law including the filing of petition under Workmen Compensation Act. However, in the circumstances, no costs.

4. As a sequel, the miscellaneous petitions, if any, pending in this MACMA shall stand closed.
