THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5576 of 2009 ORDER: (per the Hon'ble Sri Justice Sanjay Kumar) The writ petition is liable to be dismissed on more than one ground.
The writ petition was filed at a point of time when the erstwhile State of Andhra Pradesh was in existence, but it was instituted against the Government of Andhra Pradesh and not against the State. The grievance of the petitioner was with regard to the restoration of cheque power to the 8th respondent, the Sarpanch of Velimela Gram Panchayat, Medak District, who was impleaded 'eo nomine'.
A counter-affidavit was filed as long back as in the year 2009, wherein the District Panchayat Officer, Medak, stated that after due verification of the record, cheque power was restored to the 8th respondent.
No reply-affidavit was filed rebutting the averments made in the said counter-affidavit. Further, as the term of a Grampanchayat is normally for five years, the 8th respondent would have demitted Office by this time.
In the totality of the above stated circumstances, we are of the opinion that this writ petition can no longer be maintained on facts as well as on technical grounds.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
