The subject matter of writ petition relates to encroachment of road margin on southern side of Saibaba Temple in Kondabalavaripalem village, Kakumanu Mandal, Guntur district.

The complaint of the petitioner is that the 1st Respondent is not moving in the matter and removing the encroachment of road margin on the southern side of the temple. The 1st Respondent accepted the encroachment of road margin, and issued notice, vide ROC.1/ 2012/ 28.02.2012, but has not taken the notice to its logical end. 3.

After perusing the material available on record and admitted circumstances, I am satisfied that the 1st Respondent is directed to conclude the enquiry initiated through notice, dated 28.02.2012, within six weeks from the date of receipt of copy of this order and remove the encroachment by the temporary structures in road margin. The petitioner is given liberty to communicate copy of the order within two weeks from today to respondents for timely disposal. 4.

The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
