THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN WRIT APPEAL No.1296 of 2016 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned Government Pleader appearing for the appellants.

This Writ Appeal is confined to the direction of the learned single Judge that the writ petitioner, which is an Aided School, will also get the same support by way of maintenance grant in terms of the decision of this Court in Recognised Schools Managements Association, A.P. v. Government of A.P., Education Department1.

The fact of the matter remains that the writ petitioner is a recognized aided school. We do not find that the learned single Judge has misapplied any yardstick for the purpose of holding that the said institution will also be entitled to the benefit that was extended to similarly situated schools, which were members of the Recognized Schools Managements Association. 4.
At any rate, we do not see that this is an intra-court appeal which should be entertained by us at the instance of the State Government on the scales of justice.
The Writ Appeal fails and is, accordingly, dismissed. 1 1997 (3) ALD 40
