THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35988 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent No.3 in interfering into the civil disputes between the petitioner and respondent Nos.4 to 13 and also directing the petitioner to cancel the Deed of Trust, dated 21.9.2016, pertaining to Sri Mylar Swamy Temple Charitable Trust and directing the petitioner to get a fresh Deed of trust, as per the names advised by him, as illegal and arbitrary and consequently, to direct respondent No.3 not to interfere into the civil disputes between the petitioner and respondent Nos.4 to 13 in respect of the affairs of the said trust.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that respondent No.3 will not interfere in any of the civil disputes pending before the petitioner and respondent Nos.4 to 13 more particularly, in respect of the affairs of the aforesaid trust. 4.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.3 is hereby directed not to interfere in any of the civil disputes pending before the petitioner and respondent Nos.4 to 13, more particularly, in connection with the Deed of Trust,

dated 21.9.2016. At the same time, the present order will not stand in the way of respondent No.3 to proceed with the investigation if any complaint is registered against the petitioner for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
