HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30609 OF 2017 ORDER :

This petition is filed for a writ of Mandamus declaring the action of the respondents in not reviewing suspension of the petitioner, as illegal and arbitrary and for a consequential direction to the respondents to review the order of suspension of the petitioner in terms of Judgment rendered by the Apex Court in Ajay Kumar Choudhary v. Union of India in Civil Appeal No.1912/2012 as well as in terms of G.O.Ms.No.86, dated 08.03.1994 and reinstate the petitioner into service. This Court had an occasion to deal with the similar issue in WP.No.26878 of 2017 wherein this Court directed the 1st respondent therein to consider the case of the petitioner therein for review of suspension order in terms of G.O.Ms.No.86, dated 08.03.1994 and in terms of the Judgment rendered by the Apex Court referred to above and take action accordingly.

For the reasons alike in WP.No.26878 of 2017, this writ petition is disposed of directing the 1st respondent to consider the case of the petitioner for review of suspension order in terms of G.O.Ms.No.86, dated 08.03.1994 and in terms of Judgment rendered by the Apex Court in Ajay Kumar Choudhary v. Union of India in Civil Appeal No.1912/2012

and take action accordingly within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
