THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1028 OF 2002 AND CROSS OBJECTIONS (SR) No.5859 of 2010 COMMON JUDGMENT:(per Hon'ble Sri Justice K.C. Bhanu) This appeal, under Section 54 of the Land Acquisition Act, 1894 (for short, 'the Act'), is filed by the Referring Officer challenging the Order and decree, dated 28.04.2001, in Land Acquisition Original Petition No.198 of 1996, whereunder and whereby, reference made under Section 31(2) of the Act was allowed with costs enhancing compensation of Rs.40,000/- per acre for the acquired land, whereas aggrieved by the same, the claimant filed cross objections.

2. Heard both sides.

3. It is represented by learned counsel for both the parties that issue involved in this appeal is squarely covered by an order of a Division Bench of this Court, dated 17.03.1998, rendered in Appeal Suit No.2913 of 2009.

4. Following the said order, this Appeal Suit is dismissed and the cross-objections are allowed holding that the claimant is entitled to compensation at the rate of Rs.40,000/- per acre for dry lands and Rs.55,000/- per acre for wet lands. It is needless to observe that the claimant is entitled to all statutory benefits. There shall be no order as to costs. Miscellaneous petitions, if any,

pending in this appeal shall stand closed.
