Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.2418 of Dabbuthimmayapalli Village, Kodimyal Mandal, Karimnagar District. The second respondent inspected the shop of the petitioner on 19.08.2015 and found some variation in the stock. Subsequently, a case under Section 6-A of the Essential Act was registered against the petitioner and it is pending before the Joint Collector, Karimnagar. The authorization of the petitioner is valid upto 31.03.2017. When the stock was not supplied for the month of September 2015, though the authorization of the petitioner is in force, the present writ petition is filed.

3. It is needless to mention that so long as the authorization of the petitioner is in subsistence, he is entitled to receive the essential commodities. In this case, the authoriastion of the petitioner found to be valid and in force as on today.

4. In the circumstances, the Writ Petition is disposed of directing the second respondent to release the stock to the petitioner so long as his authorization is valid and in force.
