Respondents This court made the following :

ORDER :

One Mr.Dubba Gangaram worked as Driver in Jagtial Municipality. He died on 12.12.2017 while he was in service. On the application made by the elder brother of petitioner herein who is 5th respondent herein to provide appointment on compassionate grounds, he was appointed by order dated 31.1.2019 as Junior Assistant.

Petitioner now contends that his brother i.e. 5th respondent should not have been given appointment and he should have given appointment. According to the petitioner, his brother and mother have colluded and without intimation and without his consent, obtained employment and the same is illegal.

According to compassionate appointment scheme, spouse or dependent family member of the deceased, who died while in service, is entitled to be appointed on compassionate grounds. The scheme does not prescribe who should be given preference. It appears that the petitioner is married and living separately and whereas his brother- 5th respondent and mother are living together. Even according to the admission of the petitioner, his mother supported 5th respondent in securing employment. If that being so, it cannot be said that the appointment of 5th respondent on compassionate grounds is illegal and in contravention of the scheme. 4.

For the foregoing reasons, the writ petition is dismissed. Pending miscellaneous petitions shall stand closed. No order as to costs.
