THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7716 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.327 of 2023, on the file of RGI Airport Police Station, Cyberabad Commissionarate, registered for the offences under Sections 408 and 420 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner was arrested on the basis of the complaint made by the Assistant General Manager, Nexa Adarsha Auto World Private Limited, Shamshabad. In the complaint, it was alleged that this petitioner was Evaluator. His job was to evaluate the cars purchased. The Company would resell the cars after repairing the vehicles or do job work. The allegation against the petitioner is that he was evaluating the cars from

customers and selling to customers directly causing loss to Nexa show room.

Even according to the remand report, all the details of the prosecution are available with the Police. The offences alleged against the petitioner are punishable for less than 7 years. According to the remand report, the petitioner was arrested without giving notice under Section 41-A Cr.P.C. which is in violation of Satender Kumar Antil vs. Central Bureau of Investigation1. 5.

In the said circumstances, the petitioner can be granted bail subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to the satisfaction of I Additional Junior Civil Judge-Cum-XII Additional Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner/Accused after release shall appear before the Station House Officer, RGI 1 SLP (Crl).No.5191 of 2021

Airport Police Station every Monday for a period of eight weeks and thereafter, as when required, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
