HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18627 of 2018 ORDER:

This writ petition is filed seeking the following relief :- " ..... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondent No.3 in passing the proceedings No.A1/ Admin/ 3181/ 2017 dt.03.11.2017 suspending the Writ petitioner from his service until the conclusion of the disciplinary proceedings without following the due process of law as illegal, arbitrary, unilateral ......" Heard Ms.P.Sumalatha, learned counsel for the petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he is working as a Senior Accountant with the respondents and he has been discharging his duties to the best satisfaction of his superiors and everyone concerned. While so, the disciplinary authority has placed the petitioner under suspension vide proceedings dated 03.11.2017 on the alleged ground that he has intentionally added arrears of pension to the pensioners by breaking the password of the District Treasury Officer.

Learned counsel appearing for the petitioner submits that since 2017 onwards, the respondents are continuing the petitioner under suspension without reviewing his suspension order in accordance with G.O.Ms.No.86 dated 08.03.1994 and, therefore, sought to pass appropriate orders in the writ petition directing the respondents to review the suspension order passed against the petitioner, strictly in terms of G.O.Ms.No.86 dated 08.03.1994. The learned Government Pleader appearing for the respondents contends that the suspension order passed against

the petitioner will be reviewed in terms of G.O.Ms.No.86, dated 08.03.1994.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension order passed against the petitioner in terms of G.O.Ms.No.86, dated 08.03.1994, and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
