THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.2137 of 2017 ORDER:

When the matter is called, it is reported that the issue in the present Writ Petition is squarely covered by the order of this Court in W.P.No.41610 of 2016, dated 05-12-2016 and a copy of the same is placed on record along with the writ petition as material paper.

In view of the above, there shall be following similar order in this case also:

Learned Government Pleader (Mines and Geology), on instructions, submits that the seizure of vehicle is on account of extraction of sand from unauthorized areas and the petitioner has to apply for appropriate orders under G.O.Ms.No.42 Industries and Commerce (Mines-II) Department dated 29.03.2016 and after such request is made to second respondent, the same will be considered and orders are passed within one week from such representation. The statement is placed on record. Petitioner is given liberty to represent to second respondent for release of vehicle within one week from today and on such representation being made by petitioner, the second respondent passes order within seven (7) days from the date of receipt of copy of the representation. If the petitioner is required to comply with

condition, the second respondent is further directed to release the vehicle after the petitioner complying with the condition imposed by second respondent.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
