HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21051 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not paying the house rent allowance, although the petitioner is staying in the quarter which is not provided with bath rooms and latrines in terms of Clause No.8.3.2 of National Coal Wage Agreement No.II as per award dated 2.3.1994 in I.D.No.27 of 1990 of the Industrial Tribunal-I, Hyderabad and as per the directions of this Court dated 31.7.1996 in WVMP No.87 of 1995 in W.P.No.15449 of 1994 as confirmed by the Division Bench vide judgment dated 24.04.1997 in W.A.No.415 of 1996, as illegal and arbitrary.

When the matter is taken up for hearing, it is reported by the learned standing counsel for the respondents that the petitioner had retired from service during pendency of the writ petition. Therefore, the cause in the writ petition does not survive and, accordingly, the writ petition is dismissed as infructuous.
