THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY A.S.M.P.No.1375 of 2015 in A.S.No.2763 of 2000, & CROSS OBJECTIONS (SR) No.89174 of 2000 COMMON JUDGMENT:

Both the appellant/1st defendant and the 1st respondent/plaintiff are present and they are identified by their respective counsel. The terms of compromise are read over and explained to them in Telugu and they admitted them to be true and correct. Since I find that the compromise is voluntary and for the benefit of both parties, it is a fit case to permit them to enter into compromise. Accordingly, A.S.M.P.No.1375 of 2015 is ordered.

It is stated by both the counsel that respondents 2 and 3 are not necessary parties to the compromise as they are only tenants and they already vacated the premises. However, the Appeal Suit No.2763 of 2000 has already been dismissed for default against them on 20.10.2011.

As the appellant and the 1st respondent are permitted to enter into compromise as per order in A.S.M.P.No.1375 of 2015, A.S.No.2763 of 2000 is allowed by passing a decree in terms of compromise. Consequently, the Cross-Objections (SR) No.89174 of 2000 is dismissed. Registry is directed to annex copy of compromise memo to the decree copy. There shall be no order as to costs.
