This writ petition is filed seeking the following relief - "...issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents tin re-counting the marks of the petitioner in respect of the subject 'Production Technology' (Subject code X 0321) exam of II B. Tech I-Semester R07 supplementary with Hall Ticket No. 06391A0336 as illegal, arbitrary and violative of Article 14 of the constitution of India and apart from being violative of principles of

natural justice and consequently direct the respondents to recount the market is respect of the subject 'Production Technology' (Subject code X 0321) exam of II B.Tech I-semester R07 supplementary with Hall Ticket No. 06391A0336 of the petitioner and consequently direct the respondents to permit the petitioner to pursue the III year of B. Tech Mechanical course..."

This Court while issuing notice before admission on 09.11.2009 granted interim direction permitting the petitioner to appear in the first semester exam of III year B.Tech.

Learned counsel for the petitioner submits that in the light of the interim order passed by this Court, nothing survives for adjudication in this writ petition. In view of the said submission, the writ petition is closed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
