Heard the learned Counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents.
The petitioners herein preferred revision petition before the second respondent under the provisions of the Board of Revenue Standing Orders questioning the orders of the third respondent dated 09.03.2015 in proceedings D.Dis. (E4)/836/13 cancelling the assignment granted in their favour. Along with the revision petition, the petitioners also filed stay petition seeking stay of the operation of the proceedings dated 09.03.2015. It is the grievance of the petitioners that the second respondent has neither passed orders on the stay petition nor disposed of the revision petition till date. It is the case of the petitioners that under Paragraph 18(2) of the Andhra Pradesh Board of Revenue Standing Order 15, the second respondent is under legal obligation to register, assign number and thereafter dispose of either revision petition itself or pass orders on the stay petition and that non discharge of such legal obligation is illegal.
Having heard the learned Counsel on either side and considering the material available on record, I deem it appropriate to dispose of the Writ Petition directing the second respondent to consider and dispose of either revision petition filed by the petitioners against the orders of the third respondent dated 09.03.2015 or pass appropriate orders on the stay petition filed therewith pending disposal of the revision petition, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. Subject to the above direction, the Writ Petition is disposed of at the admission stage.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs. ---------------------------------------------- JUSTICE CHALLA KODANDA RAM Dated 21st April, 2015
