THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL CRI MI NAL PETI TI ON No.11652 of 2016 ORDER:

This criminal petition is filed questioning the order of the learned III Metropolitan Magistrate, Cyberabad, L.B.Nagar, R.R.District, dated 30.06.2016 passed in Crl.MP.No.965/2016 in DVC.No.11/2008. The grievance of the petitioner is that while disposing of Crl.MP.No.965/2016, the Court below directed release of the petitioner/husband on three conditions, one of which was to deposit the passport and it will kept with the court till disposal of Crl.MP.No.1669/2012. For early disposal of Crl.MP.No.1669/2012, the 2nd respondent/wife has filed Crl.P.No.8970/2016 and this Court by order dated 01.07.2016 directed the Court below to dispose of Crl.MP.No.1669/2012 within a period of one month. Now it is represented that the petitioner/husband has also filed Crl.MP.No.1118/2016 for setting aside the order passed by the court below while granting bail in Crl.MP.No.1669/2012.

In view of the facts and circumstances of the case, I deem it appropriate to direct the Court below to dispose of both Crl.MP.Nos.1669/2012 & 1118/2016 positively within a period of one month from the date of receipt of a copy of this order.

The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
