Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise.
With the consent of both sides, the Writ Petition is disposed of at the admission stage.
The present Writ Petition came to be filed seeking to declare the action of the respondents in not issuing Form-2B Restaurant and Bar Licence despite fulfilling all the conditions required under A.P. Excise (Grant of Licence of Selling by Bar and Conditions of Licence) Rules, 2005 as illegal and arbitrary and a direction to the respondents to pass appropriate orders on written representation dated 27.02.2016 made by the petitioner.
The grievance of the petitioner appears to be that his representation, dated 27.02.2016 made within the stipulated time to the Commissioner of Prohibition and Excise for grant of 2-B Restaurant and Bar Licence is not considered till date.
Without going into merits of the case and having regard to the circumstances stated above, the Writ Petition is disposed of directing the authorities concerned to consider the representation dated 27.02.2016 made by the petitioner seeking grant of Restaurant and Bar Licence in Form 2-B in accordance with law, as early as possible, preferably within a period of three weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
