This is a second round of writ petition where the petitioner is forced to approach this Court complaining about non-disposal of the appeal which is said to be pending before the 3rd respondent-Revenue Divisional Officer, filed under Section 5(5) of the A.P. Rights in Land & Pattadar Pass Books Act, 1971 (for short, "the Act").
This Court, by order dated 01.09.2014, while disposing of the earlier Writ Petition No.22105 of 2014, filed by the petitioner herein, directed the 3rd respondent-R.D.O, to dispose of the Appeal No.33 of 2014, expeditiously. It is needless to mention that when no time is fixed in the order, the same is required to be complied within a period of two months from the date of the order. And even as per the relevant writ rules, even assuming that there is no time mentioned in the order, the authorities are expected and obligated to take necessary steps within a reasonable time. Accordingly, the writ petition is disposed of, with a direction to the 3rd respondentR.D.O, to pass appropriate orders on the appeal filed by the petitioner within a period of three months from today, in accordance with law.
