HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 45362 of 2016 Order:
This Writ Petition was filed challenging the registration of Crime No.153 of 2015 by the second respondent pursuant to a complaint lodged by the third respondent on 27.05.2016. The complaint was registered under Sections 355, 506 read with 34 IPC and Section 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) (Amendment) Act, 2015.
This Court carefully perused the complaint lodged by the third respondent and after going through the complaint it cannot be said that registration of crime is bad in law. But, however, the complaint has to be investigated by the police. In the circumstances, without expressing any opinion on the merits, the second respondent is directed to complete the investigation in accordance with law duly complying with the provisions of Section 41-A of the Code of Criminal Procedure. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
