HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE Nos. 1130 and 1141 of 2019 COMMON ORDER:

Both the Criminal Revision Cases are filed by the owner of the properties, aggrieved by the dismissal of the application under Section 451 of Cr.P.C. Since the issue in both the Criminal Revision Cases is one and the same, the same are being disposed of by this common order. 2.

The only prayer made by the learned counsel for the petitioners in both the revisions is that though the petitioners filed supportive documents before the lower Court in support of their contentions, but the same have not been considered by the lower Court and seeks a direction to the lower Court to deal with the matter afresh after considering the documents filed along with the petition under Section 451 of Cr.P.C.

In the light of the prayer made by the learned Counsel for the petitioners, the matter is remitted back to the XII Additional Chief Metropolitan Magistrate, Hyderabad, with a direction to dispose of the petitions filed by the petitioners under Section 451 of Cr.P.C., afresh in the light of the supportive documents filed along with the petitions, within a period of one month from the date of receipt of a copy of the order, after giving sufficient opportunity to the petitioner, accused and the learned Public Prosecutor.

With the above direction, both the Criminal Revision Cases are disposed of. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
