THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29702 OF 2015 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent-Corporation in not taking any action for grant of permission for construction of compound wall around the petitioner's property admeasuring 155 sq. yards covered by Sy.No.19/6 of Madhavadhara Village, Vishakapatnam, pursuant to her representations dated 16-3-2014 and 6-4-2015, nor acquiring the property and paying compensation, as being illegal, arbitrary and unconstitutional, and to issue appropriate consequential directions.
2. Learned counsel for the petitioner stated that when the petitioner was away residing in Orissa, the respondent-Corporation had formed a metal road through petitioner's property without any notice or initiating any land acquisition proceedings and, therefore, she filed suit OSNo.2408 of 1997 for mandatory injunction to remove the metal road and the said suit was also allowed vide judgment 12-12-2001, and in spite of that, when the petitioner with a view to protect her property, made representations dated 16-3-2014 and 6-4-2015, seeking permission to construct compound wall around her property, the respondent-Corporation did not move in the matter and considered her representations.
3. Learned Standing Counsel for the respondent-Corporation, on instructions, submits that the Corporation is taking necessary steps to dispose of the representations made by the petitioner in accordance with law, within a time frame.
4. In view of this submission made by the learned Standing Counsel for the respondent-Corporation, writ petition is disposed of directing the respondentCorporation to consider the representations dated 16-3-2014 and 6-4-2015
made by the petitioner and pass appropriate orders thereon in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Miscellaneous petitions, if any, pending in this Writ Petition shall stand disposed of. No order as to costs.
