Gunnam Ranga Rao, v. State Of Andhra Pradesh,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.Nos.25090 and 17046 of 2016 COMMON ORDER :
Heard the counsel for petitioner; the learned Government Pleader for Revenue (Andhra Pradesh) for respondent nos.4 and 5; Sri N. Venkateswarlu, counsel for 3rd respondent; and Sri O. Manoher Reddy, counsel for 6th respondent.
2. The point which arises in these two Writ Petitions is whether there is a cart-track in Survey Nos.70 and 72 of Pedapuram Village and Municipality.
3.
While the petitioners in both the Writ Petitions assert that there is such cart-track on the basis of a village map produced by them, the learned Government Pleader for Revenue (Andhra Pradesh) as well as Sri O. Manoher Reddy, counsel for 6th respondent, dispute the very existence of such cart-track therein and contend that in the Revenue Records such as the F.M.B. and the Pahani for the said survey numbers, no such cart-track is shown.
4. Since this is a dispute of fact about the existence of the cart- track in these two survey numbers which cannot be conveniently adjudicated in this Writ Petition, granting liberty to petitioners in both the Writ Petitions to
approach the competent Civil Court and seek appropriate relief, these two Writ Petitions are disposed of. No order as to costs.
5. Status quo orders granted earlier in both the Writ Petitions shall stand vacated.
6.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed. __________________________________ JUSTICE M.S.RAMACHANDRA RAO Date: 12-08-2016 Ndr/*
