The petitioner aggrieved by the order of resumption dated 05.12.2013 filed statutory appeal before 3rd respondent on 16.04.2018 .
One of the circumstances now relied on by petitioner is that the order of resumption was not communicated on the petitioner and the petitioner has knowledge of the resumption order through the order in W.P.No.9797 of 2018, dated 28.03.2018. I have perused the record. Heard both the counsel. The prayer is against inaction in disposing of the stay petition filed by petitioner. The petitioner is challenging the order of resumption. Therefore, in the fitness of things, the 3rd respondent is directed to dispose of the appeal as expeditiously as possible preferably within three months from the date of receipt of a copy of this order. The parties are directed not to change physical features of the subjec t matter of appeal and/ or create third party interest pending disposal of the appeal.
